Throughout these Terms:
- “we”, “us”, and “our” refer to Panache Artistry
- “you” and “customer” refer to the purchaser
By placing an order on our website, you agree to be bound by these Terms & Conditions, together with our:
- Shipping & Delivery Policy
- Returns & Cancellations Policy
- Privacy Policy
2. Scope & Application
These Terms apply to consumer purchases only.
Orders placed under:
- trade accounts
- project pricing
- commercial or hospitality use
are governed by separate Trade Terms & Conditions, which override these Terms where applicable.
3. Product Information & Accuracy
We take reasonable care to ensure that product descriptions, specifications, images, and pricing are accurate at the time of publication.
However:
- images are for illustrative purposes only
- natural materials may vary in colour, grain, or finish
- dimensions may vary slightly due to manufacturing tolerances
Minor variations do not constitute a fault.
4. Pricing & Payment
All prices are displayed in GBP and are inclusive of VAT, unless otherwise stated.
Payment must be made in full at the time of ordering unless alternative arrangements have been agreed in writing.
We reserve the right to:
- correct pricing errors
- cancel orders placed at an incorrect price
- refuse or cancel orders at our discretion
In such cases, a full refund will be issued.
5. Made-to-Order & Non-Stock Items
Many Panache Artistry products are made to order, including items that are:
- manufactured specifically after an order is placed
- produced as part of a batch or project run
- not held as finished stock
Once production has commenced:
cancellation rights may be limited in accordance with our Returns & Cancellations Policy and your statutory rights, and
specifications may no longer be changeable.
Made-to-order items are supplied in accordance with our Returns & Cancellations Policy and your statutory rights.
6. Order Acceptance & Confirmation
An order is considered accepted only once:
- payment has been received, and
- an order confirmation has been issued
We reserve the right to decline or cancel orders due to:
- availability issues
- pricing errors
- suspected fraud
- inability to fulfil the order
7. Delivery & Risk
Delivery is governed by our Shipping & Delivery Policy.
Risk in the goods passes to the customer upon successful delivery.
Where delivery fails due to customer-related issues, the customer may remain responsible for reasonable additional costs incurred, but risk in the goods remains with Panache Artistry until delivery is completed.
Ownership of goods passes once payment has been made in full.
8. Customer Responsibilities
Customers are responsible for:
- ensuring delivery access is suitable
- measuring doorways, staircases, lifts, and access routes
- arranging assistance if required
- being available to receive the delivery
Failure to meet these responsibilities may result in additional charges and does not constitute a valid cancellation.
9. Inspection, Damage & Faults
Customers should inspect goods promptly upon delivery.
If goods are:
- damaged
- faulty
- incorrect
- not as described
you must notify us within a reasonable time after delivery, providing clear photographic evidence where possible.
We will assess the issue and provide an appropriate remedy in accordance with:
- Our Returns & Cancellations Policy
- The Consumer Rights Act 2015
10. Returns, Refunds & Cancellations
Returns, refunds, and cancellations are governed by our Returns & Cancellations Policy, which forms part of these Terms.
Where applicable, your statutory rights remain unaffected.
11. International Orders
International orders may be subject to:
- customs duties
- import VAT
- local taxes
- clearance or handling fees
These charges are the responsibility of the customer unless explicitly stated otherwise.
We are not responsible for delays, penalties, or returns arising from customs processing.
12. Limitation of Liability
Nothing in these Terms limits or excludes our liability for:
- death or personal injury caused by negligence
- fraud or fraudulent misrepresentation
- any liability that cannot be excluded under UK law
Subject to the above, we are not liable for:
- indirect or consequential losses
- loss of profit, business, or opportunity
- delays caused by third parties or force majeure events
Our total liability shall not exceed the value of the goods supplied.
13. Force Majeure
We are not liable for failure or delay in performance due to events beyond our reasonable control, including but not limited to:
- acts of God
- strikes
- transport disruption
- customs delays
- regulatory changes
- pandemics or border restrictions
14. Intellectual Property
All content on our website, including images, text, designs, and trademarks, is the property of Panache Artistry or its licensors.
You may not reproduce, distribute, or use any content without prior written consent.
15. Governing Law & Jurisdiction
These Terms & Conditions are governed by the laws of England and Wales.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
